Waiver & Consent

By participating in any sound baths services organized or conducted by SOUNDBATH HAVEN BARBADOS, I, the undersigned participant, acknowledge and agree to the following terms and conditions:

Assumption of Risk: I understand that participating in sound bath sessions, I am required to read the contraindications thoroughly and consult my physician to ensure that I can partake in said activity. I understand that during the floating sound bath I will be laying on an air mattress in an eye mask. I understand certain inherent risks and dangers, including but not limited to accidents, injury, illness, or property damage. I voluntarily assume all such risks associated with my participation.

Physical Condition: I will attend the class in a non-intoxicated state, and the facilitator reserves the right to refuse entry should I be found to be under the influence. I confirm that I am physically fit and have no medical conditions or injuries that would prevent me from participating in sound bath sessions. I agree to disclose any relevant medical conditions or limitations to the representative of Sound Bath Haven Barbados, and the representative at the hotel/villa, before participating.

No Pregnant Participants: Your safety and well-being are important to us, and we do not recommend our classes during pregnancy. For that reason, we unfortunately cannot accept participants who are pregnant. Please note the following guidelines: a) Participation at Your Own Risk: All participation during pregnancy is solely at your own risk. Should you choose to avoid our advice and without our knowledge participate in one of our sessions, you acknowledge that you have read and understood this information and that you assume full responsibility for any risks associated with your participation during pregnancy.

Release of Liability: I hereby release Marisa T. Daniel and SOUNDBATH HAVEN BARBADOS, its owners, instructors, employees, agents and partners from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me during my participation in any sound bath sessions.

Waiver of Claims: I waive and relinquish all claims and rights I may have against Marisa T. Daniel and SOUNDBATH HAVEN BARBADOS, arising out of my participation in sound bath sessions, including claims for negligence, breach of warranty, or any other cause of action.

Indemnification: I agree to indemnify and hold harmless Marisa T. Daniel and SOUNDBATH HAVEN BARBADOS, its owners, instructors, employees, and agents from any and all claims, damages, costs, or expenses, including legal fees, arising out of my participation in sound baths.

Photographic Release: I grant Marisa T. Daniel and SOUNDBATH HAVEN BARBADOS the right to use photographs, videos, or other media taken during the sound bath sessions for promotional purposes without compensation. All photography and videography taken at the sound bath sessions, in addition to promotional materials used to promote the services at the hotel/villa/residence, must comply with the guidelines of the hotel/villa/residence. And therefore, be reviewed by the hotel/villa/residence and approved before distribution.

Severability: If any provision of this liability waiver is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

 

CONTRAINDICATIONS

Sound healing is a gentle but powerful tool but may not be suitable for everyone. If you are being treated for a serious physical or mental disorder or are taking any medications, it is important to check with your doctor before proceeding with treatments. Please let the person you book your sound bath with know if you are on any medication or have any medical conditions either relating or not relating to the below.

Below is a list of issues that may either rule sound therapy out for you or where you need to check with your doctor first. Sound healing is NOT suitable for anyone with the following issues:

Any deep vein thrombosis in the leg or known thrombi: The vibrations and movements associated with sound healing, especially if applied directly to the affected area, could potentially dislodge these blood clots.

Open wounds, acute inflammations and tumors.

If you are post-surgery (before the sutures have been removed and the scar is not fully healed and closed).

Pacemaker or defibrillator: (cannot be placed on or near the affected area). Some medical devices, such as pacemakers or cochlear implants, may be affected by the electromagnetic fields generated by certain sound bath instruments. Individuals with such devices should consult with their healthcare provider before participating in a sound bath to determine if it is safe for them.

Pregnant women: Although there is limited scientific research on the effects of sound healing specifically on pregnant women and their developing fetus there is concern that intense or prolonged exposure to certain frequencies or vibrations could potentially impact fetal development. While gentle sounds may be soothing and beneficial for relaxation, there is a lack of comprehensive data on how different sound frequencies may affect the developing fetus. Sound healing sessions can sometimes facilitate emotional release or deep relaxation, which may be accompanied by strong emotions or physical sensations. While this can be therapeutic for some individuals, pregnant women may need to consider the potential impact of intense emotional experiences on their well-being and the well-being of the fetus.

Epilepsy: Certain sound frequencies or patterns can act as triggers for seizures in susceptible individuals. While the specific triggers can vary from person to person, sounds that are loud, repetitive, or have rapid changes in intensity may pose a higher risk of provoking seizure activity in some epileptic individuals. Sound healing sessions often involve immersive auditory experiences, which may include vibrations, tones, or rhythms that could potentially overstimulate the brain and increase the risk of seizure activity.

 

Consult doctor before attending:

If you have whiplash - Sound therapy can be used minimum 3 days after treatment. A metallic implant (cannot be placed on or near the affected area). Metal implants, such as surgical screws, plates, or joint replacements, can potentially interfere with the transmission and reception of sound waves. Depending on the size, location, and material of the implant, sound waves may be reflected, absorbed, or distorted, affecting the intended therapeutic effects of the sound healing session. Vibrations from sound healing instruments may cause discomfort or pain in individuals with metal implants, especially if the implants are located near the surface of the skin or in sensitive areas. The vibrations could exacerbate existing discomfort or irritate surrounding tissues, leading to discomfort during or after the session.

People with carotid stenosis, cardiac pacemakers, artificial heart valves, or cardiac arrhythmias, a stent, a shunt, a deep brain stimulation device (DBS) Let THE PERSON YOU BOOK YOUR SESSION WITH know if you have any of the above conditions or if you have implants, devices, pins, screws, artificial joints, inflamed joints and veins, inflammatory skin disorders, weeping eczema, diseased veins as I cannot work near to this affected area.

Children: Participants must be of the age 18 years and older, children are not permitted to partake. Should a child who is not of the required age participate in one of our sessions without our knowledge, you acknowledge that you have read and understood this information and that you assume full responsibility for any risks.

I have read this liability waiver and the contraindications carefully and understand its contents. I voluntarily agree to be bound by its terms and conditions. I acknowledge that I am signing this waiver freely by filling in the information below on this form, and without any undue influence.

I HEREBY GIVE MY CONSENT TO THIS WAIVER AND TO PARTICIPATE IN SOUNDBATH HAVEN BARBADOS SOUND BATH SESSIONS, AND BY FILLING IN THIS FORM, I AGREE TO ALL TERMS AND CONDITIONS.
